Minnesota Workers' Compensation Benefits are governed by the law
as it exists on your date of injury as governed by Minnesota Statute
Section 176 and as interpreted in case law.
Basic Outline of Benefits Available:
Given that the Minnesota State Legislature has the ability to modify the statute
from year to year, benefits available to one employee may differ from other
employees given the differences in the laws at the time of injury. As such, it is
important to find representation from an attorney that handles workers'
compensation claims on a regular basis.
Wage Loss Benefits:
Temporary Total Disability Benefits
Temporary Partial Disability Benefits
Permanent Total Disability Benefits
Medical Benefits:
Reasonable and necessary medical treatment which will aid in
curing or relieving the effects of the work injury.
Function Impairment Benefits:
Permanent partial disability is a payment for the loss of use of, or
the loss of, body function. These benefits are paid according to a
compensation schedule that establishes a percentage of disability.
Vocational Rehabilitation Benefits:
Assistance of a Qualified Rehabilitation Consultant of your choosing
hired to assist you in returning to your former job or to a job related
to that employment. The goal of this benefit is to assist you in
returning to a job in another work area which will put you in an
economic position as close as possible to what you would have
enjoyed without disability. This assistance may include direct job
placement, on-the-job training or formal retraining.
Death Benefits:
Benefits provided to the dependents of a worker whose death was
caused by a work-related injury. The amount of the benefit depends
on the number of dependents, the decedent's wage at the time of
injury and/or death and upon the dependents receipt of benefits from
other sources, such as Social Security.
